Terms of Service

The short version

Use Better Prompted to make better ads and install the automations behind them. Don’t abuse the tool, don’t send spam through it, and don’t use it to hurt anyone. Pay us what we agreed on for the work we do for you. If anything goes sideways, we’ll talk before we sue — and your liability is capped at what you’ve paid us in the last 12 months.

Who this is between

These terms are an agreement between you (the person or business using betterprompted.com or signing up for our services) and Prompted, LLC, doing business as Better Prompted (“we”, “us”). By using the site or engaging us for services, you agree to these terms.

What we provide

• The landing analyzer: a free draft ad and one-line automation plan generated from a business URL.
• Optional personalized video ad rendering (8-second and longer cinematic versions).
• Paid services: automation installation, ad management, video production, and ongoing retainer-based work as separately agreed in a written proposal or invoice.

Acceptable use

You agree not to:

• Use the site to generate ads for illegal products or services, adult content, regulated substances outside of licensed contexts, or anything that violates Meta, Google, or SMS carrier policies.
• Submit other people’s phone numbers without their permission.
• Attempt to extract, reverse-engineer, or scrape the tool beyond normal use.
• Use our infrastructure to send bulk messages we didn’t agree to handle.

Payment

The landing analyzer and its video ads are free. Paid services — automation installation, ad management, retainer work — are billed against a written proposal or invoice. Unless stated otherwise, fees are due on receipt, non-refundable once work is underway, and denominated in US dollars.

Your content & our tools

Anything you give us — your business name, logo, photos, copy, the ads we make for you — stays yours. You grant us a license to use it only to deliver the services you hired us for.

Anything that powers the tool — our software, automation templates, prompts, prompts-behind-the-prompts, the BP process — stays ours. Hiring us doesn’t transfer ownership of any of it.

AI output — what to expect

The ads, scripts, and plans we generate are produced with a mix of AI models we run on your behalf. They’re drafts, not guaranteed results. We review everything before installation, but the first-pass output on the landing page is generated in seconds and may occasionally say something we’d never ship. If you see something off, tell us — that’s literally the pitch.

SMS messaging

Our SMS practices are governed by our Privacy Policy. Mobile information and phone numbers are never shared with or sold to third parties or affiliates for marketing purposes. Reply STOP to unsubscribe and HELP for help.

Disclaimers

The site and free analyzer are provided “as is.” We don’t guarantee specific results from running an ad we drafted or installing an automation we recommended — ad performance depends on budget, audience, market, seasonality, creative, and a hundred other things. We do guarantee we’ll show up and do honest work.

Limitation of liability

To the extent allowed by law, our total liability for any claim arising out of these terms or our services is capped at the greater of (a) what you’ve paid us in the twelve months before the claim, or (b) one hundred dollars. We’re not liable for indirect, consequential, or lost-profit damages.

Termination

You can stop using the site at any time, no notice needed. We can suspend or terminate access if you violate these terms or abuse the system. For paid engagements, termination procedures are spelled out in the signed proposal — these terms don’t override that.

Governing law

These terms are governed by the laws of the State of Arizona, USA, without regard to its conflict-of-law rules. Any dispute is brought in the state or federal courts of Maricopa County, Arizona, and both parties consent to that jurisdiction.

Changes

If we change these terms, we’ll update this page and the “Last updated” date at the top. If the change materially affects your rights, we’ll flag it on the site before it takes effect.
